
GOOD HOPE, Ala. – Good Hope’s City Council held its second May meeting at Good Hope City Hall Tuesday night and they kicked things off with a public hearing regarding the vacation of Williams Drive. After hearing public comments, the council closed the hearing and approved Resolution No: 010-2025 to vacate the property. The Council then moved on to its next new business items, appointing officers for the upcoming Municipal election and adjusting pay for the city attorney.
Before adjourning, the council discussed bids for the city’s multi-use community center project and after going through different funding options, awarded the bid to United Contracting and Design, LLC. The bid with United is also contingent on Americans with Disabilities Act (ADA) approval.
The Good Hope City Council will hold its next regularly scheduled meeting on Monday, June 9 at 6:30 p.m. at Good Hope City Hall.
RESOLUTION NO: 010-2025
RESOLUTION APPROVING THE VACATION OF WILLIAMS DRIVE
“WHEREAS, the City of Good Hope, an Alabama municipality, is the owner of the street known as Williams Drive, legal description marked as Exhibit “B” Road to be Vacated; and
WHEREAS, CITY OF GOOD HOPE, an Alabama Municipality, is the owner of the
WHEREAS, a Petition to vacate a portion of the southwesterly right-of-way of County Road #437, duly executed by CITY OF GOOD HOPE, as the abutting property owner, has been presented to the City Council (the “City Council’) of the City of Good Hope, Alabama (the “City”), a municipal corporation, for the assent and approval of the governing body, said Petition with map attached being hereto affixed, marked Exhibit “B” and made a part hereof; and
WHEREAS, the Petition is filed in accordance with the provisions of 823-4-20, Code of
Alabama, 1975, which provides that any street or alley may be vacated, in whole or in part, by the owner or owners of the land abutting the street or alley or abutting that portion of the street or alley desired to be vacated; and
WHEREAS, the portion of the right-of-way of Williams Drive to be vacated is more particularly described as follows:
Commence at the purported Northeast corner of the Southeast Quarter of the Southeast Quarter Section 5, Township 11 South, Range 3 West, Cullman County, Alabama; Thence along the accepted North line of the Southeast Quarter of the Southeast Quarter 589°47’57” W 848.96 Feet to a point; Thence S05°49’57” W 17.67 feet to a found magnetic nail at the intersection of the center Of Williams Drive (Known as Old Bremen Road) and the Southerly Right of Way Of Municipal Drive being the point of beginning of the center of said road to be Vacated (Right of Way being 10 feet either side of the following described Centerline); Thence along the center of Williams Drive (Know as Old Bremen Road) the following chord bearings and distances: S05°49’57” W 63.37 feet to a Found magnetic nail; Thence S12°42’30” W 69.44 feet to a found magnetic nail; Thence S12°40’19” Wfeet to a found magnetic nail; Thence S23°06’27” W 64.70 Feet to a found magnetic nail; Thence S13°44’37” W 43.23 feet to a found ½” Capped rebar (Conn L.S. #17831); Thence S14°41’49” W 24.53 feet to a found ½” capped rebar (Conn L.S. #17831); Thence S15°03’33” W 93.54 feet to a Set magnetic nail; Thence S14°59’01” W 56.92 feet to a set magnetic nail; Thence S17°23’36″‘ W 36.16 feet to a set magnetic nail; Thence S20°07’36” W 25.47 feet To a set magnetic nail; Thence S27°47’09” W 18.02 feet to a set magnetic nail on The Northerly Right of Way of Municipal Drive being the end of the center of Said road.
Being further described according to and as shown on that certain survey or drawing prepared by Kelly L. Whitfield, Registered Surveyor, Licensed Professional No. 19901, attached hereto and marked Exhibit “B”.
WHEREAS, said portion of Williams Drive – Exhibit B is not being used by anyone as a public street; and
WHEREAS, the Petition states that no property owners will be deprived of any right
they may have to convenient and reasonable means of ingress and egress to and from their property as a result of the requested vacation; and
WHEREAS, a public hearing was conducted by the City Council on the day of May 27, 2025 at which all persons were given the opportunity to be heard in favor of or in opposition to the proposed vacation; and
WHEREAS, public notice of the public hearing was provided in accordance with §23-4-2, Code of Alabama, 1975; and
WHEREAS, the City Council has determined that it is in the best interest of the City to vacate said portion as described in the attached Petition and said portion of the right-of-way of said street should be vacated; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Good Hope that the vacation of the above-described portion of is assented to and approved and the same is hereby vacated pursuant to the provisions of Section 23-4-20, et.seq. of the Code of Alabama, and also pursuant to said Code in §35-2-54, subject to the conditions below.
BE IT FURTHER RESOLVED that the vacation of said portion of the southwesterly right-of-way of County Road #437, and the conveyance of the vacated right-of-way to Petitioner are subject to the fulfillment of the following conditions by Petitioner:
The Petitioner shall convey to the Utilities Board of the City of Good Hope, in a form satisfactory to the Board, any utility easement as depicted on the survey or drawing prepared by Kelly L. Whitfield, Registered Surveyor, attached hereto and marked Exhibit “B”.
The Petitioner shall convey to the City of Good Hope, in a form satisfactory to the City Attorney, an easement for the installation, replacement, inspection, maintenance and repair of an environmental monitoring well as depicted on the survey or drawing prepared by Kelly L. Whitfield, Registered Surveyor, attached hereto and marked Exhibit “B”.
BE IT FURTHER RESOLVED that the City of Good Hope, Alabama, a municipal corporation, remise, release and quitclaim unto CITY OF GOOD HOPE, whatever right, title and interest the said City of Good Hope, Alabama, may have acquired in and to the above- described portion of South 10 Street by virtue of the dedication or vacation of said roadway or otherwise, subject to the reservation of the above-described water main easement.
BE IT FURTHER RESOLVED that, upon satisfaction of the above conditions, Jerry Bartlett, the Mayor of the City of Good Hope, Alabama, a municipal corporation, be and he is hereby authorized and directed on behalf of the City of Good Hope, Alabama, to execute a quitclaim deed to CITY OF GOOD HOPE, subject to the reservation of the above-described water main easement, for the purpose of carrying out the intent and intention of this Resolution and that Christie Chamblee, City Clerk, be and is hereby authorized and directed on behalf of the City of Good Hope, Alabama, to attest the same.
BE IT FURTHER RESOLVED that the City Clerk will cause a copy of this Resolution to be filed in the Probate Office of Cullman County, Alabama, and shall further cause a copy of this Resolution to be published once in a newspaper of general circulation in Cullman County, Alabama, no less than fourteen (14) days after its adoption.”

RESOLUTION #012-2025
RESOLUTION APPOINTING ELECTION OFFICERS
“WHEREAS, a Regular Municipal Election will be held in the City of Good Hope on the 26th day of August, 2025; and a runoff election to be held, if necessary, on the 23rd day of September, 2025; and
WHEREAS, Section 11-46-27 of the Alabama Code of 1975, as amended, provides, in part, that the municipal governing body, not less than 15 days before the holding of any municipal election, shall appoint from the qualified electors of the municipality, officers to hold the election as follows: where electronic ballot counters are used, at least one inspector and three clerks.
Inspector pay for election day to be $150.00 and all other clerks will be $125.00. Additional $25.00 to be added for attending election class on Thursday, August 7, 2025, 10:00 am – 12:00 pm or 6:00 pm to 8:00 pm.
NOW THEREFORE, be it RESOLVED by the City Council of the City of Good Hope,
Alabama that the election officers for said election shall be as follows:

RESOLUTION NO: 013-2025
REVISE CITY ATTORNEY PAY
“BE IT ORDAINED by the Council of the City of Good Hope, Alabama that the Honorable Rita P. Nicholas, Attorney at Law, was appointed to the office of Good Hope City Attorney and hold such office until such time as her successor is appointed and qualified with Resolution No: 017-2020.
BE IT FURTHER RESOLVED, that the said City Attorney shall not only truly represent the City of Good Hope but that it shall be her duty to represent and be the Attorney for each and all of the Boards and Commissions that do operate or may during the term of this appointment operate with and under the municipal authority of the City of Good Hope, Alabama, as proved by the laws of the State of Alabama. It shall be the duty of the City Attorney to advise and consult with the Mayor, Council, Clerk, Department Supervisors, Officials of the various municipal boards and other municipal officers with regard to various legal problems that may arise in their respective positions.
BE IT FURTHER RESOLVED the City Attorney shall receive a retainer of $1,000.00 as a monthly retainer and such additional sums as the Council may from time to time approve, beginning on the 1st day of June, 2025.”
