CULLMAN, Ala. – An additional arrest has been made in connection with the ongoing investigation involving Infusion Wellness and Spa. On Wednesday, Aug. 20, 2025, at approximately 3:08 p.m., the Cullman Police Department, assisted by the Cullman County Sheriff’s Office, took Kody Ray Smith, 30, of Hanceville into custody.
According to the CPD, Smith is facing 11 charges (six felonies and five misdemeanors), in the case, including:
- Criminal conspiracy to commit a controlled substance crime
- Attempt to commit a controlled substance crime
- 4 counts of unlawful possession of a controlled substance by fraud
- 5 counts of fourth-degree criminal possession of a forged instrument
Whitney LeAnn Cheatham, 33, of Cullman, owns Infusion Wellness and Spa. She was arrested on Aug. 16, 2025, and is facing 25 charges in the case. Cheatham was married to Smith; however, it is unclear if this is still the case.
Her charges include:
- 3 counts of drug trafficking
- 1 count of criminal conspiracy to commit drug trafficking
- 1 count of attempted drug trafficking
- 6 counts of unlawful distribution of a controlled substance
- 1 count of attempted unlawful distribution of a controlled substance
- 1 count of criminal conspiracy to unlawfully distribute controlled substances
- 1 count of practicing medicine without a license
- 11 counts of fourth-degree forgery
At the time of Cheatham’s arrest, Cullman County District Attorney Champ Crocker said, “These charges stem from the illegal procurement of controlled substances through forged prescriptions originating from Ms. Cheatham’s business.”

The Cullman Police Department is also actively searching for Cheatham’s father, posting on Aug. 18, 2025: “The Cullman Police Department is seeking the public’s help in locating Kelvin Neil Cheatham, who is wanted on multiple felony charges, including drug trafficking. These charges are connected to the ongoing investigation at Infusion Wellness and Spa, where his daughter, Whitney Cheatham, was taken into custody on August 16, 2025. Anyone with information on the whereabouts of Kelvin Cheatham is urged to contact the Cullman Police Department at 256-734-1434.”

As this case remains under active investigation, further arrests or charges may be made as additional information becomes available, the department said.
